특허법인 명신은 1972년 설립된 이래 한국, 일본, 미국, 유럽의 유수의 전자회사, 기계회사, 화학회사 등 당해 기술 분야에서 선두 주자에 속하는 기업의 업무를 처리하여 왔습니다. 그동안 취급하여 온 사건의 범위 및 수에서 뿐만 아니라 소속 변리사의 경험과 전문성, 업무의 신뢰성 및 신속성에 있어서 당소는 명실 공히 국내 최고 수준의 특허법인 중의 하나입니다.

김명신 대표변리사는 한국과 아시아의 변리사업계와 지식재산분야의 제도발전에도 헌신하여 왔습니다. 대한변리사회의 회장과 아시아변리사회의 회장을 역임하였고, 변리사시험과목(민사소송법, 외국어)의 개혁, 특허법원 설립 캠페인, 지식재산민·형사판례집의 발행, 변리사의 민사소송실무연수 기획·실시, 변리사회관 건립운동, 변리사감정제도의 개선, 변리사무료상담 봉사제도 마련, 변리사회창립50주년기념행사, 실용신안 무심사법안에 대한 반대운동, 지식재산기본법의 제정운동, 변리사법 개정, 변리사직업 보험제도, 소멸된 특허권의 회복, 특허청의 4년도분 이후 특허료 납부안내 및 홈페이지 개설, 변리사회의 특별회비제도(회관기금 및 공제연금)의 창안 등 수많은 산업재산권분야의 법률 제·개정 및 제도발전을 위하여 헌신하여 왔고, 모두 성공리에 완수하였습니다. 또한 국회가 승인한 사단법인 지식재산포럼 회장 및 대통령 소속 국가지식재산위원회 위원 겸 지식재산보호자문위원회의 위원장으로 활동하였습니다.

위와 같은 공로로 김명신 대표변리사는 2013년 5월 15일 발명의날 시상식에서 대통령으로부터 은탑산업훈장을 받았습니다. 지난 1998년에도 대통령으로부터 동탑산업훈장을 받은 바 있습니다.

  MYUNG-SHIN & PARTNERS  HISTORY 
 

·    1980

Mr. Kim served as the vice-president of the Korea Intellectual Property Research Society, Inc., contributed to legislation regarding the computer program protection law and the complete revision of the copyright law and established the special membership fee system of the Korean Patent Attorneys Association for the association building fund and the mutual-aid pension.

·    1990

Mr. Kim served as the President of the Korean Patent Attorneys Association from 1996 to 1998, contributed to reformation of the subject matter of the patent attorney examination(civil procedure and foreign language), improvement of the expert opinion system by patent attorneys, enforcement of the practical training course of civil suits for patent attorneys, establishment of pro bono legal services by patent attorneys, campaign for establishing KPAA building, movement against the bill regarding the non-examination registration system of utility models and the commemorative event for the 50th anniversary of KPAA. Additionally, in 1997, Mr. Kim published the first case book for intellectual property in Korea. Further, he led the legal campaign which, in 1998, resulted in the establishment of the Korean Patent Court (High Court level) and the patent attorney insurance system. Mr. Kim was awarded the Bronze Tower Order of Industrial Service Merit by President Dae-Jung Kim in 1998.

·    2000

Mr. Kim served as the President of the Asian Patent Attorneys Association from 2000 to 2003. Starting in 2005, he served as the President of the Intellectual Property Forum approved by the Korean National Assembly and led the campaign to enact an Intellectual Property Framework Act. Additionally, Mr. Kim led the 2005 revision of Korean Patent Law to allow for the restoration of an extinguished patent right. At his suggestion, KIPO launched the payment notice service for annuities and opened the related page in the KIPO website.

·    2011

The Intellectual Property Framework Act, first proposed by Mr. Kim, at last came into effect on July 20, 2011. Mr. Kim serves as an active member of the Presidential Council on Intellectual Property and is the Chairman of the Intellectual Property Protection Sub-committee.

·    2013

Mr. Kim was awarded the Silver Tower Order of Industrial Service Merit by President Geun-Hye Park on May 15, 2013.

Patent / Utility Model

We have about 40 years of experience in drafting patent specifications, translating foreign language specifications into Korean, preparing patent applications, filing and prosecuting patent applications before the Korean Intellectual Property Office. We cover all technological areas and our staff has been organized into three working groups: Mechanical and Metallurgical group, Electrical and Electronic group and Chemical and Biotechnology group. Each group consists of patent attorneys and patent engineers with strong technical backgrounds.

Trademark / Design

We provide trademark search services, based on the largest databases in Korea and expert opinions on such matters as availability in the Korean market and in the registration of a subject trademark. We are well experienced in preparing, filing and prosecuting trademark or design applications before the Korean Intellectual Property Office. We also have extensive experience in the areas of oppositions, invalidation trials and cancellation trials. Our firm has successfully represented famous trademarks.

Dispute Resolution / Enforcement / Litigation

We provide search services of the prior art for patents, registered trademarks and designs and have expertise in analyzing the prior art and providing expert opinions on the availability of registration or the possibility of infringement. On a regular basis, our firm represents clients on warning letters, preliminary or permanent injunction, damage compensation, and criminal actions. Our patent litigation team consists of an attorney at law as litigator, patent attorneys and patent engineers with specific technological backgrounds.

Our litigating attorney commenced his career as a patent attorney with a technical background in 1993 and has extensive experiences in patent litigation. Moreover, we have counsels who are former high-level judges, have successfully worked together with our litigation team.

Trade Secret / Copyright / Unfair Competition

Our services extend to the areas of unfair competition prevention and trade secret protection. Under the Korean Unfair Competition Prevention and Trade Secret Protection Act, we advise clients on the best strategy to protect valuable information or new technologies that are not covered by the patent system. Our practice covers the prevention of unfair competition by third parties. We also help clients in preparing and filing copyright registration applications and often represent clients in mediation procedures before the Korean Copyright Commission for Mediation and Conciliation or in litigation before the courts. Additionally, we advise clients regarding domain name disputes, internet and e-commerce issues.

We have a full ranges of experience in these practice areas including search and watch services of unfair competition activities, warning letters, mediation, preliminary or permanent injunctions, damage compensation and criminal actions.

License / IP Evaluation / Technology Transfer

We assist our clients in licensing strategies, negotiating licensing, drafting and reviewing license contracts regarding patents, trademarks, trade secrets, franchising, etc. We also provide Intellectual Property evaluation services, including due diligence, validity studies, liability studies, assessments of IP and help clients in transferring their technology in Korea.

당소는 다양한 최신 데이터베이스를 이용한 선행특허기술·등록상표·등록디자인에 대한 조사, 타인의 특허기술에 대한 분석, 무효가능성, 권리침해 가능성에 관한 감정, 타인의 등록상표에 대한 무효여부, 침해여부에 대한 감정 등에 관한 풍부한 경험을 가지고 있습니다. 또한, 제3자가 특허기술을 무단 사용하는 경우, 경고장, 특허권침해금지 가처분, 손해배상 소송, 형사고소 등을 포함한 각종 분쟁 업무를 수행하고 있습니다. 특히, 당소는 특허침해 분쟁시 관련 기술에 관한 정확한 분석을 중시하여, 전공분야 변리사, 엔지니어 및 변호사로 구성된 팀을 운영하는 방식으로 업무를 수행하고 있습니다.
